Marijuana use by employees – medical or recreational – is an issue of debate in every workplace. Although, marijuana remains a scheduled drug and is illegal under federal law, in recent years, there has been a trend toward legalization of marijuana at the state level and a move by many employers to “ignore” positive tests for retention and recruitment purposes. Addressing the complexities of marijuana use by employees including federal contractor considerations in meeting the obligations imposed under the Drug Free Workplace Act, this presentation will discuss the current state of the law in various states as they relate to employers’ efforts to maintain a drug-free workplace and the pitfalls in establishing a “drug free workplace.” It will also address how courts have treated the conflict between state and federal law in relation to drug testing in employment, reasonable accommodation, and discrimination. With particular focus on multi-state employers, federal contractors, and employers in states where medical and/or recreational is or likely will become legal, our presenters will offer practical insight as to the best practices for compliance and tips on effective and enforceable policies.
