Public Sector Town Hall: Wage and Hour Compliance for Public Employers

Public employers in Wisconsin are increasingly facing challenging wage and hour compliance issues and Department of Labor investigations. With higher scrutiny in this area by plaintiffs' counsel and the Department of Labor, the challenge now carries with it significant financial liability and litigation expense. The public-sector has unique exposures under the FLSA related to specific compensation practices not available to the private sector. This Town Hall will help public-sector employers understand risk zones so they can better address their practices on:

  1. tracking and calculating compensable work time
  2. calculating the regular rate of pay and FLSA overtime wages in light of nondiscretionary payments and other forms of wages
  3. shift trades (substitutions), special overtime rules for police, fire, and jailers, and the different types of compensatory time
  4. correctly identifying who is a volunteer
  5. classification of exempt versus non-exempt employee
