Derek Waterstreet is a member of the Litigation and Risk Management Practice Group. His practice focuses on commercial, business, and construction-related litigation matters. Derek has experience representing clients in disputes involving contracts, fraud and misrepresentation claims, false advertising claims, class actions, landlord-tenant matters, and both residential and commercial construction matters. Derek also practices in and has experience handling federal Indian law matters, including fee-to-trust land appeals. He also has experience in handling civil harassment-injunctions and criminal defense matters.
Derek is committed to understanding his client’s needs and values. He helps clients understand the litigation process, and the different strategies and potential outcomes available. Derek strives to surpass client expectations by strongly advocating his clients’ interests.
Prior to joining von Briesen, Derek was actively involved in the legal community. At Marquette University Law School Derek served as a member on the Marquette Law Review, held a research assistant position for Professor Patricia Bradford, and participated in Moot Court activities. He competed in the Jenkins Honors Moot Court Competition as well as the National Criminal Procedure Tournament in San Diego where he and his partner were awarded the Best Petitioner Brief. Derek also held internships at both the state and federal levels. At the state level, he interned at the Milwaukee County District Attorney’s Office as a prosecutor practicing under the Wisconsin student practice rule. He also served as a student legal intern at the Eau Claire Office of the Wisconsin State Public Defenders. At the federal level, Derek interned as a judicial intern for the Chief United States Judge, William C. Griesbach, for the United States District Court of the Eastern District of Wisconsin.
Derek currently provides pro bono representation for Legal Action of Wisconsin’s Eviction Defense Project, which provides assistance to low-income tenants facing eviction in Milwaukee County. He also is involved in the community and serves as a committee member for the Ducks Unlimited Milwaukee Chapter.
Derek is a member of the State Bar of Wisconsin, the Milwaukee Bar Association, and the Eastern District of Wisconsin Bar Association.
