The American Rescue Plan Act (“ARPA”), signed into law on March 11, 2021, created significant new COBRA obligations for employers. From a six-month, employer-paid COBRA subsidy requirement to an obligation to offer COBRA to certain former employees who previously declined coverage, employers are now faced with evaluating compliance options and obligations. These new requirements require planning and careful consideration to avoid compliance “gotchas” and unanticipated costs.
